1. In the year 1997 the Government of Maharashtra reorganized the Directorate of Prosecution, M.S., Mumbai and brought prosecutors under administrative control of Director, Directorate of Prosecution wide Govt. Resolution No. Spp 2295/CR 149/POL-10, dated 20.5.1997.
2. The Government framed the rules of recruitment for post of Director, Deputy Director, Assistant Director and Public Prosecutor, Additional Public Prosecutor and Assistant Public Prosecutor.
3. The entire Directorate of Prosecution is working under the Home Department, State of Maharashtra.
4. The Dy. Directors are promoted from the post of Assistant Director & Public Prosecutor. The Deputy Director are appointed for each revenue division hence at present there are six posts of the Deputy Directors in the entire state of Maharashtra.
5. The Assistant Director & Public Prosecutors are the heads of the district and they were supposed to supervise and the working of all Prosecutors in the concerned District. Assistant Director & Public Prosecutor are promoted from the post of Additional Public Prosecutor.
6. Additional Public Prosecutors are appointed to look after prosecution work in the Sessions Court, in the ratio of 50:50 i.E. 50% by promotion from the cadre of Assistant Public Prosecutor and remaining 50% by direct recruitment through Maharashtra Public Service Commission.
7. Assistant Public Prosecutors are appointed by the Government of Maharashtra, Home department through Maharashtra Public Service Commission and they works in the courts of Magistrates.
8. The present strength of prosecutors is less as compared to the functioning courts in the state. Hence Assistant Public Prosecutors u/s 25 (3) of Cr.P.C. Are appointed in courts where no regular Assistant Public Prosecutors appointed to ensure that no criminal court in state remained unrepresented. The Assistant Public Prosecutors appointed u/s 25 (3) of Cr.P.C. Is entitled to honorarium of Rs.2000/- per day on base of effective hearing.
9. The Director of Prosecution supervises the working of the Prosecutors under him.
10. The Government of Maharashtra by GR dated 16.09.2024 has appointed Director General (Legal & Technical) as Head of the Department of Directorate of Prosecution, M.S., Mumbai.
